TelleYoga Terms of Service

1) Eligibility (17+)

The Service is intended for individuals aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.

2) The Service

TelleYoga helps you track your yoga and fitness journey. You can log activities, monitor progress, and view statistics and personalized insights to support consistency and motivation.

3) Your Account

• Registration: you may need to provide name, username, and email address.
• Responsibility: keep your credentials secure and notify us of suspected unauthorized access.
• Accuracy: provide accurate information and keep it up to date.

4) Your Content

• Ownership: you retain ownership of your User Content.
• License: you grant TelleYoga a license to host, store, process, and display User Content solely to operate, provide, and improve the Service and to comply with law.
• Your responsibility: you are responsible for User Content and represent you have the rights to provide it.

5) Acceptable Use

You agree not to misuse the Service. For example, you will not:

• Use the Service in violation of law or regulation.
• Attempt unauthorized access to systems or accounts.
• Disrupt the Service or introduce malware.
• Reverse engineer or attempt to extract source code except where prohibited by law.
• Infringe intellectual property or privacy rights.

6) Health and Fitness Disclaimer

The Service is for informational and tracking purposes only and is not medical advice. Consult a qualified professional before starting or changing any fitness program. You use the Service at your own risk.

7) Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge you have read and understood the Privacy Policy.

8) Intellectual Property

The Service and its associated software, trademarks, and logos (excluding User Content) are owned by TelleYoga or its licensors and are protected by law. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own non-commercial purposes, subject to these Terms.

9) Termination

• By you: you may stop using the Service at any time and request account deletion if available.
• By us: we may suspend or terminate access if we reasonably believe you violated these Terms, your use creates risk, the Service is being abused, or we must comply with law.
• Effect: the license ends; certain sections survive (including IP, disclaimers, liability limits, and dispute resolution).

10) Changes to the Service or Terms

We may modify, suspend, or discontinue the Service at any time, and we may update these Terms. If changes are material, we will provide notice through the Service or by other appropriate means. Continued use means you accept the updated Terms.

11) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". To the maximum extent permitted by law, TelleYoga disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of Liability

To the maximum extent permitted by law, TelleYoga will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, use, goodwill, or other intangible losses.

To the maximum extent permitted by law, TelleYoga's total liability will not exceed the amount you paid to TelleYoga for the Service in the 12 months before the event giving rise to the claim (or, if you paid nothing, USD $10).

13) Indemnity

You agree to indemnify and hold harmless TelleYoga and its team members from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms.

14) Governing Law

These Terms will be governed by the laws of the jurisdiction of TelleYoga's principal place of business, without regard to conflict of laws principles, except where applicable law requires otherwise.

15) Dispute Resolution and Binding Arbitration

Please read carefully. This section affects your rights.

• Informal resolution: contact us at kaydeng89quantumcom@outlook.com first with a brief description of the dispute.
• Binding arbitration: if not resolved informally, disputes will be resolved by binding arbitration on an individual basis, not in court, except for certain injunctive/equitable relief.
• No class actions: to the fullest extent permitted by law, disputes will be brought only on an individual basis.
• Procedure: unless required by law, arbitration will be in English, by a single arbitrator, in the jurisdiction of our principal place of business (or remotely by agreement), under applicable local arbitration rules.
• Time limit: to the extent permitted by law, claims must be brought within one (1) year unless a longer period is required by applicable law.

16) App Store (Apple) Additional Terms

If you downloaded the App from Apple Inc.'s App Store ("Apple"), you acknowledge and agree that:

• These Terms are between you and TelleYoga, not Apple.
• Apple has no obligation to provide maintenance or support services for the App.
• If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing claims relating to the App, including product liability and consumer protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
